The special three-judge High Court bench concluded yesterday(04) the trial in the case filed by the attorney general against defendants, including former health minister Keheliya Rambukwella, over the procurement of substandard human immunoglobulin injection doses.Accordingly, the court fixed November 25 for written submissions and November 30 for oral submissions.The presentation of the defendants' statements was also concluded on November 03The calling of the defendants' statements commenced on the 29th of last month, and all defendants except the ninth defendant, who is evading the court, presented their statements from the dock.The attorney general filed this case in the High Court against the defendants under thirteen charges, including conspiring to fraudulently misappropriate Rs. 1,444 million of republic funds and committing criminal breach of trust by supplying 6,195 vials of non-drug substances namely human immunoglobulin and Rituximab to the medical supplies division of the ministry of health.The prosecution presented 350 witnesses and nearly 300 case productions to the court.Sugath Janaka Fernando, owner of Isoless Biotech Pharma Company which allegedly imported substandard injections; Dr. Kapila Wickramanayake, director of the medical supplies division; Shanthini Solomon, assistant director of the medical supplies division; Neran Dhananjaya, accountant; Sujith Kumara, stock controller; Janaka Sri Chandragupta, former secretary to the ministry of health; Dr. Herath Mudiyanselage Dharmasiri Rathnakumara Herath, deputy director general of the medical supplies unit; Keheliya Rambukwella, former health minister; Dr. Jayanath Butpitiya, procurement committee member of the emergency procurement process who is evading court and residing abroad; Dr. Saman Rathnayake, additional secretary to the ministry of health; Dr. Arambegedara Thusitha Sudarshana, a director of the medical supplies division; and Wijith Gunasekara, former chairman of the National Medicines Regulatory Authority, have been named as defendants in this case.According to complaints lodged with the Criminal Investigation Department and the Commission to Investigate Allegations of Bribery or Corruption in October 2023 by Kamantha Thushara, chairman of the Pubudu Citizen Power Organization against Bribery, Corruption and Waste, the CID commenced investigations into this incident from October 13, 2023, and subsequently reported facts to the Magistrate's Court.Following the filing of the case in the Magistrate's Court and the conclusion of all subsequent investigations, extracts of the investigations were forwarded to the Attorney General on February 06 last year, and accordingly the Attorney General filed indictments against these defendants before the Colombo Special Three-Judge High Court, with the serving of indictments to the defendants taking place on September 16 of last year.The case was thereafter tried on a daily basis until yesterday(04).Deputy Solicitor General Lakmini Girihagama appeared for the prosecution on behalf of the attorney general.
